Judicial Panel to Reconsider Decision That Allowed Trump to Deploy Military Forces to Portland
The federal appeals court has upheld a prohibition on sending national guard in the Oregon city, after a recent court ruling.
Appeals Court Concurs to Rehear Legal Matter
The ninth circuit court of appeals ruled on Tuesday that it would reexamine the case concerning the executive power with an larger panel of 11 judges. The judicial body also vacated a earlier ruling from a three-judge panel that had sided with the administration.
Ongoing Dispute Over Troop Deployment
This order represents the latest development in a long-running court case over whether the administration has the legal right and justification to send state military units in Portland. Approximately 200 federalized guard members have been in uncertainty since the end of September when the deployment effort was initiated in due to ongoing demonstrations.
Conflicting Arguments
The federal government has argued that government employees at the immigration center in south Portland were facing threats, while city and state officials maintain that municipal police have command of the circumstances.
In defiance of characterizations of the city as a conflict zone, locals have been sharing footage of lush hiking trails and a vibrant culinary culture, and organizing events such as an protest bicycle event against the “militarization of our city”.
Court Proceedings
The Tuesday ruling came after a US district judge in the city issued two legal injunctions this period – one preventing the federal control of the Oregon national guard, and another stopping the use of any military personnel in the state, after attempts to circumvent the initial injunction by mobilizing out-of-state forces.
On Monday, the appeals court had put the first ruling on hold – permitting command of 200 Oregon national guard – but the second ruling stayed effective, preventing the physical sending of the forces.

The Tuesday decision means the issue will be heard by the full court – with both rulings under consideration simultaneously – by a group of eleven justices.
“This ruling shows that the truth matters and that the judicial system are working to hold this administration accountable. The constitution limits the president’s power, and local populations cannot be treated as a training ground for unchecked federal authority,” said the state attorney general in a official comment.
“The judicial body is sending a clear message: the president cannot send the armed forces into American urban areas unnecessarily. We will continue protecting Oregon’s laws, values, and sovereignty as this legal proceeding progresses and our fight continues in the judicial system.”
